Getaway Giveaway Official Rules
1. ELIGIBILITY: OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE 21 YEARS OF AGE OR OLDER AS OF DATE OF ENTRY. NO PURCHASE NECESSARY TO WIN. This promotion (the "Drawings for Prizes") is sponsored by Ginn Hammock Beach Resort, (the "Sponsor"), 200 Ocean Crest Drive, Palm Coast, Florida 32137. Officers, employees or agents of any organizations, including co-sponsors, who are directly involved with this contest, and employees of Ginn Resorts, its affiliates, subsidiaries, or officers are not eligible to enter the Drawings for Prizes. All federal, state and local laws and regulations apply. Void in Rhode Island and any other state or jurisdiction where prohibited, taxed or restricted by law.
2. REGISTERING BY MAIL: Registration can also be made by sending your name, address, phone number and email address to the address above. Written registration or referrals that contain typographical errors, printing errors or that are materially mutilated, altered, incomplete, tampered with, illegible, inaccurate, forged or irregular in any way or otherwise not in compliance with these Official Rules shall be void.
WINNER SELECTION AND NOTIFICATION: All mail in entrants and automatically entered guests that have stayed at the resort between May 15 and September 2, 2008 will be combined to create one master database. From that database a random winner will be chosen.
Sponsor's staff or the staff of an affiliated agency shall oversee the Drawings for Prizes and the decision of the staff shall be final and binding as to all matters related to the selection.
Winners will be notified using information provided by the entrant on the guest registration card or mail in entry. Notification will be by e-mail or by phone, at Sponsor's election. (Sponsor is not required to leave phone messages.) Three (3) attempts will be made to notify the Winner. Winner will have five (5) days from last attempt notification by Sponsor to accept the prize. If the third attempt is unsuccessful, an alternate winner will be selected by the choice of a second random database entry. The prize package winner will be made available on GinnHammockBeach.com.
Sponsor shall not be responsible or liable for late, lost, misdirected or unsuccessful efforts to notify the winners. Winners will be required to execute an Affidavit or Eligibility and Publicity/Liability Release to be completed and returned prior to prize collection. If any prize is forfeited under these Official Rules, a corresponding prize will be awarded to a randomly selected alternate winner.
3. ODDS OF WINNING: The actual odds of winning will depend upon the actual number of entries received by the deadline of 11:59 PM on the last day of the time period.
4. PRIZES: The prize package, valued in access of $2,000, will consist of a three night stay at Ginn Hammock Beach Resort in a three-bedroom Ocean Tower Suite (maximum occupancy - six people), two rounds of golf at either the Ocean or Conservatory golf course and two 50 minute spa treatments.
Only the prizes specified above will be awarded. Prizes are non-transferable, with no cash redemption or equivalent and subject to date availability. All federal, state and local income taxes connected to the prize are the sole responsibility of the winners. Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prizes awarded. Prize value represents Sponsor's best good-faith estimate as of May 8, 2008. This is not an offer in any jurisdiction where prior registration is required. Proposed drawing amenities are subject to change without notice. Winners accept all conditions, restrictions, requirements and/or regulations required by the Sponsor in connection with acceptance of the prize. Prize must be redeemed within one year of winning.
5. GENERAL CONDITIONS: Sponsor not responsible for late, lost, misdirected, damaged or illegible entries. Sponsor, its employees, affiliates and promotional agencies are not responsible for, nor liable for, any losses or damages of any kind arising from participation in this promotion, acceptance, possession or use of a prize, or prize-related activities. Except where prohibited by law, acceptance of prize constitutes permission to use Winner's name, likeness, photograph, and city and state of residence for purposes of advertising and promotion by Sponsor worldwide, without limitation and without further compensation.
Winner, by acceptance of the prize, agrees to release the Sponsor from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. Entrants, by entering this contest, agree that the Sponsor and its employees, officers, directors, shareholders, agents, and their respective parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (a) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (b) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures or difficulties; (c) errors in transmission; (d) any condition caused by events beyond the control of Sponsor that may cause Drawing either to be disrupted or corrupted; (e) any injuries, losses, or damages of any kind caused by a prize resulting from acceptance, possession, use or misuse of a prize, or from participation in Drawing; or (f) any printing or typographical errors in any materials associated with the Drawing.
The failure of the Sponsor and their employees, officers, directors, shareholders, agents, and their respective parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors to comply with any provision of the Official Rules due to an act of God, hurricane, ware, terrorism, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of any of the parties or other force majeure event will not be considered a breach of the Official Rules by Sponsor.
If technical difficulties compromise the integrity or ability to continue on-line entry, the Sponsor reserves the right to modify or terminate on-line entry. If the Drawing is cancelled prior to the Entry Deadline, Notice will be posted at GinnHammockBeach.com. In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsor's control, which corrupt the integrity, administration, security or proper operation of the Drawing, the Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Drawing. In the event of cancellation, the Sponsor reserves the right to award prizes from among all eligible non-suspect entries received prior to the event requiring such cancellation.
Any attempt by an entrant to deliberately damage any Website or undermine the legitimate operation of this Drawing is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.
Contest Ends September 2, 2008. The Official Rules are subject to change.
6. PRIVACY: Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at http://www.hammockbeach.com/legal.aspx. By participating in the Drawing, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
7. CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Drawing, shall be governed by, and construed in accordance with, the substantive laws of the State of Florida.
8. NOTIFICATION OF WINNERS: To obtain written notification of winners, please send a request and self-addressed, stamped envelope, to be received by Sponsor within ninety (90) days after the selection dates, to the following address: Ginn Hammock Beach Resort, Marketing Department, 200 Ocean Crest Drive, Palm Coast, Florida 32137.
